Terms and Conditions

In the terms and conditions (the “Terms and Conditions”) set out below, references to “we”, “our”, “us” and “CCS”, as the context may require, refers to Career Consultancy Services and references to “you”, “your” and the “Client”, as the context may require, refers to each and any user of any of the services provided by CCS and/or of the website, www.careerconsultancyservices.com, (the “Website”). In addition, any references to “cv” means to a curriculum vitae in respect of a Client, which has been reviewed, updated, edited and/or produced by CCS for such Client, in addition, any references to “cv” means to a curriculum vitae in respect of a Client, which has been reviewed, updated, edited and/or produced by CCS for such Client and any references to “services” means to any services provided at any time by CCS to a Client, including but not limited to, interview coaching services and services relating to cvs. For the avoidance of doubt, references herein to “the Terms and Conditions” shall be deemed to include our privacy policy which is set out below.

Acceptance of Terms

Accessing the Website and its contents and using any of the services provided by CCS constitutes deemed acceptance by the Client of the Terms and Conditions.CCS reserves the right to amend, modify or revoke any of the Terms and Conditions from time to time and without any prior notice to the Client by updating the Terms and Conditions on the Website. Your use of the Website following the posting of an updated version of the Terms and Conditions constitutes your deemed acceptance of such changes.

Service Quality and Guarantees

CCS aims to provide complete satisfaction to each Client and all cvs are reviewed, edited and/or created to a high and exacting standard. However we do not guarantee that any final draft cvs are “perfect” and “error free” and CCS is not obliged to refund the cost of the services provided in the case of any final draft cv being less than perfect. The Client is responsible for reviewing the final draft cv upon completion by CCS and if the Client requires any outstanding errors to be corrected by CCS, the Client must contact CCS within 5 days of receipt of the final draft cv. CCS do not, under any circumstances, guarantee or ensure that the Client will successfully gain employment as a result of any services provided. CCS do not guarantee that any employer will ask for a Client’s information, details and/or cv, or will interview or hire a Client or that any Client will meet the needs of any employer. We make no representation or warranty as to the final terms and duration of any appointment obtained with the assistance of services provided by CCS. Whilst we take all reasonable endeavours to ensure it is the case, we do not guarantee that any employer will keep confidential any Client information or data provided to them by CCS. If the Client is not completely satisfied with any aspect of a service or services provided to them by CCS, we request that such Client contact us as soon as possible but in any event within 28 days of receiving the applicable service or services and we will make every effort to remedy the situation.

Payment

Payment from the Client must be received in full by CCS (in cleared funds) before any services are commenced by CCS for such Client.

Limitation of Liability

No liability is accepted by CCS for any loss or damage which may arise out of any person directly or indirectly using services provided by CCS and/or relying on or using any information on the Website. CCS shall not be liable to any person using such services or such information for (a) loss of revenue, loss of actual or anticipated salary, loss of actual or anticipated profits whether arising in the normal course of business or otherwise (including, without limitation, loss of profits on contracts), loss of or damage to employment prospects, loss of opportunity, loss of the use of money, loss of anticipated savings, loss of business, loss of goodwill, loss of or damage to reputation, loss of or corruption to data, loss of management or administration time, legal and other professional fees and expenses, or (b) any indirect or consequential loss or damages however caused (including without limitation by reason of misrepresentation, negligence, other tort, breach of contract or breach of statutory duty) which arise directly or indirectly from services provided by CCS and/or information provided on the Website. However, nothing in the above shall limit or exclude CCS’ liability for fraud or for death or personal injury caused by negligence, or to the extent otherwise not permitted by law, provided that CCS’ liability shall always be limited to the total cost of the services provided to the relevant client.

Proper use of the Website

The Client will not use the Website for, or to encourage, any unlawful purpose, nor post or transmit on the Website or supply to CCS inaccurate, incomplete or false information (including biographical information about yourself and/or information about your ability to work in the United Kingdom or elsewhere), nor will the Client post or transmit to the Website any libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material.

The Client confirms that he/she will not post or transmit on the Website any material which contains any virus or other disabling services which interferes or may interfere with the operation of the Website, or which alters or deletes any information which the Client has no authority to alter or delete, or which overloads the Website by spamming or flooding it.

The Client agrees that he/she will not use any device, routine or software to crash, delay or otherwise damage the operation of the Website. The Client also confirms that he/she will not take any action that affects the reputation of CCS or that defames, abuses, harasses or threatens others.

Accuracy of Client Information

The Client is responsible for providing true and accurate details with respect to all and any information they provide to CCS, including, without limitation, details of their name, address, phone number, email address and all payment details and any details included or to be included in a cv. Failure to provide correct and accurate information can result in a refusal by CCS to provide its services.

The Client assumes all responsibility for any problems, errors and issues as well as legal liability resulting, at any time, from the provision of any incorrect, dishonest, false and/or fraudulent information to CCS.

Indemnity

The Client agrees to indemnify, defend and hold harmless CCS and its affiliates, directors, officers and employees from and against any claim, liability, cost, damage or loss CCS may incur (including without limitation legal fees and costs) as a result of any false information provided by you or any violation by you of your obligations under the Terms and Conditions.

Refusal, denial or termination of services and operations

CCS reserves the right to deny or refuse service to any Client or prospective Client for any reason and without explanation.

In the event of services being provided by CCS to a Client and the Client violating any of the Terms and Conditions, CCS reserves the right to terminate all service and contractual obligations with such Client immediately and without explanation and take any necessary legal action against such client.

Notwithstanding the provisions above, CCS may, at its discretion, discontinue or terminate operation of the Website, its services or trading name without notice at any time and for any reason.

Links to or from other websites

As a convenience to Clients, the Website contains links to external websites and you may be offered a number of automatic links to other websites which may interest you. CCS accepts no responsibility for, or liability in respect of, the content of those other websites. CCS should not be taken as having reviewed or approved such websites or their contents, nor does it warrant that any links to such websites work or are up to date. The use of any such links is entirely at your own risk. Any third parties wishing to link to the Website may do so provided links are to the home page only of the Website and provided we are notified in advance by email to support@careerconsultancyservices.com and have given our consent in writing.

Technical Disclaimer

CCS is not liable for service delays resulting from unforeseen circumstances such as technical problems including server or connection issues that are beyond our control. We will make every effort to meet deadlines and communicate with Clients in the case of technical problems.

Intellectual Property

All copyright, trademarks (registered or unregistered) and other intellectual property rights of any nature arising from all materials, content and information on the Website, including the Website’s design, layout and organisation are exclusively owned by CCS.

All copyright, trade marks (registered or unregistered) and other intellectual property rights of any nature arising from the business names CCS and Career Consultancy Services are exclusively owned by CCS.

These business names and the Website content cannot be used, copied, reproduced, republished, transmitted, downloaded, modified, framed, displayed, posted or transmitted (as the context requires) for any commercial purpose without the express prior approval in writing from CCS.

Governing Law

The Terms and Conditions will be governed by the Laws of England and the Client agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.
